Welcome to Ballston Brothers Coffee. These Terms of Service ("Terms") apply to your use of ballstonbrothers.com (the "Site") and any purchase you make from us. "We," "us," and "our" mean Ballston Brothers LLC, doing business as Ballston Brothers Coffee. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. WHO WE ARE
Ballston Brothers Coffee is a veteran-owned, family-run coffee company and mobile coffee catering business based in Ballston Spa, New York. Our store runs on Shopify, but your purchase is made directly with us.

2. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you create an account, you're responsible for keeping your login information secure and for all activity under your account. Please give us accurate, current information and keep it up to date.

3. OUR PRODUCTS
Our coffees are roasted in small batches, either by us in Ballston Spa, New York, or by our trusted partner roaster in California, to our recipes and specifications. Because coffee is an agricultural product, flavor, color, and aroma can vary slightly from batch to batch and may not exactly match descriptions or photos. Tasting notes are our honest impressions, not guarantees.

Caffeine: Our coffee contains caffeine. Some products, including high-caffeine blends, contain more caffeine than typical coffee. If you are pregnant, nursing, sensitive to caffeine, or have a medical condition, please consult your doctor before consuming.

Allergens: Our flavored and unflavored coffees may be roasted and packaged in the same facilities and on the same equipment. If you have food allergies or sensitivities, please contact us before ordering.

We may change, limit, or discontinue any product at any time, including seasonal and "Flavor of the Month" offerings.

4. ORDERS
Placing an order is an offer to buy. We may accept or decline any order, limit quantities, or cancel an order for reasons including product availability, pricing or description errors, or suspected fraud. If we cancel an order after you've been charged, we'll refund you in full.

5. PRICES AND PAYMENT
Prices are listed in U.S. dollars and don't include applicable taxes or shipping unless stated. Prices may change at any time, but the price in effect when you place your order is the price you'll pay. If a product is listed at an incorrect price because of an error, we may cancel the order and let you know. You authorize us and our payment processors to charge your chosen payment method for your purchases.

6. DISCOUNTS AND PROMOTIONS
Discount codes and promotions are subject to the terms stated in the offer, may not be combined unless stated, have no cash value, and may be changed or ended at any time. Discounts offered to veterans, active military, or first responders may require verification. If a promotion's terms conflict with these Terms, the promotion's terms apply to that offer.

7. SUBSCRIPTIONS
If you sign up for a coffee subscription, you agree to the following:
- Your subscription will automatically renew and your payment method will be charged at the frequency you selected (for example, weekly or monthly) at the then-current price, plus applicable tax and shipping, until you cancel.
- You can pause, skip, change, or cancel your subscription at any time through your account or by emailing info@ballstonbrothers.com. Changes must be made before your next billing date to apply to that order.
- Charges for orders that have already been processed or shipped are non-refundable.
- If we change your subscription price, we'll notify you in advance by email, and you can cancel before the new price takes effect.

8. SHIPPING AND DELIVERY
We ship within the United States. Orders ship from our location in Ballston Spa, New York, or directly from our partner roaster in California, depending on the product. Orders containing items from more than one location may arrive in separate packages on different days, and you won't be charged extra shipping for the split. Shipping times shown on the Site are estimates and are not guaranteed. Once your order is handed to the shipping carrier, title and risk of loss pass to you. Please make sure your shipping address is correct. We're not responsible for orders delivered to an incorrect address provided at checkout. If your order is lost or arrives damaged, please contact us as described in our Refund Policy.

9. RETURNS AND REFUNDS
All coffee sales are final. Returns and refunds for other products are handled under our Refund Policy, which is part of these Terms.

10. GIFT CARDS
Gift cards can be used only on the Site for purchases from Ballston Brothers Coffee. They can't be redeemed for cash except where required by law, and they don't expire. We're not responsible for lost or stolen gift cards.

11. CATERING AND WHOLESALE
Mobile coffee catering, event services, wholesale, custom-label, and private-label orders are governed by separate written agreements or invoices. If those agreements conflict with these Terms, the separate agreement controls for that service.

12. EMAIL AND TEXT MESSAGES
If you sign up for our emails or text messages, you agree to receive marketing messages from us. You can unsubscribe from emails at any time using the link in any email, and from text messages by replying STOP. Message and data rates may apply. Consent to marketing messages is not a condition of purchase.

13. REVIEWS AND CONTENT YOU SHARE
If you post reviews, photos, or comments on the Site or tag us on social media, you confirm the content is yours to share and is truthful. You give us a non-exclusive, royalty-free license to display and share that content in connection with our business, with credit to you where practical. We may remove any content at our discretion. Please don't post anything unlawful, misleading, offensive, or that infringes anyone else's rights.

14. OUR INTELLECTUAL PROPERTY
The Ballston Brothers name, logos, blend names, product designs, photos, text, and other content on the Site belong to us or our licensors. You may not copy, reproduce, or use them for commercial purposes without our written permission.

15. PROHIBITED USES
You agree not to use the Site to: break any law; commit fraud; interfere with the Site's security or operation; use bots, scrapers, or automated tools to access the Site or place orders without our permission; resell our products in a way that misrepresents your relationship with us; or harass, abuse, or harm others.

16. THIRD-PARTY LINKS AND PRODUCTS
The Site may link to other websites or offer products shipped by our brand partners. We're not responsible for third-party websites, their content, or their practices. Partner-brand equipment and accessories are covered by their manufacturer's warranty.

17. ERRORS
The Site may occasionally contain errors in descriptions, pricing, or availability. We may correct errors, update information, or cancel affected orders at any time without prior notice.

18. DISCLAIMER OF WARRANTIES
Except as expressly stated in these Terms and to the extent permitted by law, the Site and our products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any rights you have under applicable consumer protection law.

19. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ballston Brothers LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states don't allow certain limitations, so some of these may not apply to you.

20. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Ballston Brothers LLC and its owners, employees, and partners from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

21. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing any claim, please contact us at info@ballstonbrothers.com so we can try to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in Saratoga County, New York, and you agree to their jurisdiction. Either party may bring a qualifying claim in small claims court.

22. TERMINATION
We may suspend or end your access to the Site or your account if you violate these Terms. Sections that by their nature should survive termination, including those on payment, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.

23. GENERAL
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and us about the Site. You may not transfer your rights under these Terms. We may transfer ours, for example in connection with a sale of the business.

24. CHANGES TO THESE TERMS
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will change. Continuing to use the Site after changes are posted means you accept the updated Terms.
